JourneyAPI (“we,” “us,” or “the Service”) provides a software integration layer and application programming interface (API) that enables developers to programmatically access third-party AI image and media generation services. We act as an independent intermediary and developer tool provider.
We do not own, operate, develop, train, or control the underlying AI models accessed through our platform, including but not limited to Midjourney, DALL-E, FLUX, Stable Diffusion, Ideogram, Imagen, Runway, Luma, Kling, or Suno. These models are developed, owned, and operated by their respective companies. We make no representations regarding the continued availability of any specific third-party AI model or service.
JourneyAPI is an independent company and is not affiliated with, endorsed by, sponsored by, authorized by, licensed by, or in any way officially connected to any of the following entities or their subsidiaries, parent companies, or affiliates: Midjourney, Inc.; OpenAI, Inc.; Google LLC; Stability AI Ltd.; Black Forest Labs; Ideogram Inc.; Runway AI, Inc.; Luma AI, Inc.; Kuaishou Technology (Kling); Suno, Inc.; or any other AI model provider whose services may be accessible through our platform.
All trademarks, service marks, trade names, logos, and product names referenced on our website or in our documentation are the property of their respective owners. Their use on our platform is solely for identification and descriptive purposes and does not imply any affiliation, endorsement, or sponsorship. You must provide accurate, current, and complete information when creating an account. You are solely responsible for maintaining the confidentiality and security of your API keys. Any activity that occurs under your API key is your responsibility. Sharing API keys with unauthorized parties is prohibited. One person or legal entity per account. We reserve the right to refuse service, terminate accounts, or revoke API keys at our sole discretion.
Credits are consumed when generation tasks complete successfully. Failed generations due to upstream errors or infrastructure issues are not charged. Credits do not roll over between billing cycles. Unused credits expire at the end of each billing period.
Subscription upgrades take effect immediately. Downgrades take effect at the next billing cycle. All payments are processed through Stripe, Inc. We do not store your payment card details.
Refunds are handled on a case-by-case basis. We are not obligated to provide refunds for unused credits, plan downgrades, or service dissatisfaction. If you believe you were charged in error, contact us within 30 days.

We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice. Violation of acceptable use policies will result in forfeiture of any remaining credits without refund.
JourneyAPI relies on third-party AI model providers to deliver its core functionality. These third-party services are governed by their own terms of service, acceptable use policies, and content policies that are separate from and in addition to these Terms.
You acknowledge and agree that:
We target 99.9% API uptime but this is a goal, not a guarantee or contractual commitment. Planned maintenance will be communicated in advance when possible. We are not liable for service interruptions caused by upstream model provider outages, content policy changes, infrastructure failures, acts of God, or circumstances beyond our reasonable control.
You retain whatever rights you may have to prompts you submit and content generated through your account, subject to and limited by the terms of use, content policies, and licensing terms of the underlying third-party AI model provider(s) that generated such content.
JourneyAPI does not claim ownership of your prompts or generated outputs. However, we make no representations or warranties regarding your ownership rights to AI-generated content, as such rights depend on the applicable AI model provider's terms and applicable intellectual property law, which may vary by jurisdiction and is subject to change.
You are solely responsible for determining whether you have sufficient rights to use AI-generated content for your intended purposes, including any commercial use.
We process your data in accordance with our Privacy Policy. Prompts and generated images may be temporarily stored for task processing and delivery purposes. We do not use your prompts or generated content to train AI models.
You acknowledge that prompts you submit may be processed by third-party AI model providers, which are subject to their own privacy policies and data handling practices.
You agree to indemnify, defend, and hold harmless JourneyAPI, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) content generated through your account; (c) your violation of these Terms; (d) your violation of any rights of a third party, including intellectual property rights; or (e) your violation of any applicable law or regulation.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY AI-GENERATED CONTENT OR OUTPUT. WE DO NOT WARRANT THAT ANY SPECIFIC THIRD-PARTY AI MODEL WILL REMAIN AVAILABLE OR PERFORM IN ANY PARTICULAR MANNER.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JOURNEYAPI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR REVENUE, WHETHER ARISING FROM CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE LESSER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (US $100).
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 2, 5, 8, 10, 11, 12, and 15.
You may terminate your account at any time by contacting us. Termination does not entitle you to a refund of any prepaid credits or subscription fees.
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via the email address associated with your account. Your continued use of the Service after such notice constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and terminate your account.
These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles. Any disputes arising out of or related to these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except that either party may seek injunctive relief in any court of competent jurisdiction.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and JourneyAPI regarding the Service and supersede all prior or contemporaneous agreements, representations, and understandings.
